Scope of Services

The Micro Mavericks provides visual design and strategic services related to email marketing and lifecycle communications, including but not limited to email visual design, newsletter layout systems, promotional email creatives, abandoned cart visuals, and related consulting. All services are delivered on a project-based, subscription-based, or custom agreement basis as outlined in individual proposals or plans.

Client Responsibilities

Clients are responsible for providing accurate, complete, and timely information required to deliver services effectively. This includes brand assets, content inputs, approvals, and feedback. Delays caused by missing information or late responses may impact timelines and do not constitute a breach on our part.

Payments and Billing

All fees are charged in USD unless otherwise stated. Payments must be made in advance according to the agreed pricing plan or invoice terms. Failure to complete payment may result in service suspension or termination. Subscription plans renew automatically unless canceled prior to the renewal date. No refunds are issued for partially used billing cycles unless explicitly stated in writing.

Revisions and Modifications

Each service plan includes a defined number of revisions. Requests beyond the agreed scope or revision limit may incur additional charges. Revisions are limited to design adjustments and do not include complete redesigns unless otherwise specified. Any major changes to project scope require a revised agreement.

Intellectual Property Rights

Upon full payment, clients receive usage rights to the final approved designs for their intended marketing purposes. The Micro Mavericks retains the right to showcase completed work in portfolios, case studies, and promotional materials unless otherwise agreed. All preliminary concepts, drafts, and unused designs remain our intellectual property.

Confidentiality

We respect client confidentiality and do not disclose sensitive information shared during projects. Confidential materials are used solely for the purpose of delivering services. This obligation remains in effect even after the completion or termination of services, except where disclosure is required by law.

Limitation of Liability

The Micro Mavericks shall not be held liable for indirect, incidental, or consequential damages arising from the use of our services or website. We do not guarantee specific marketing results, revenue outcomes, or performance metrics, as these depend on multiple external factors beyond our control.

Service Availability and Changes

We reserve the right to modify, suspend, or discontinue any service, feature, or pricing at any time without prior notice. Ongoing subscriptions or active projects will be honored according to the agreed terms at the time of purchase.

Compliance with California Law

These Terms and Conditions are governed by and interpreted in accordance with the laws of the State of California, United States. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of California courts.

Termination

Either party may terminate services with written notice, subject to the terms of the active agreement. Outstanding payments must be cleared prior to termination. Upon termination, access to ongoing services and deliverables may be restricted.
